Terms and Conditions of Free of Cost renting of Oxygen Concentrators to Covid Positive patients under HOPE Program

• Healthvista India (P) Ltd (Portea) in collaboration with Hindustan Unilever Limited (HUL) and KVN Foundation (Foundation) is providing free of cost renting of Oxygen Concentrators (OCs) to Covid Positive patients under HOPE Program. The HOPE program is to coordinate and collaborate, support society with the supply of Oxygen Concentrators, in particular to Procure, distribute to needy patients, and recover post the use of the Oxygen Concentrators (“OC” or “OCs”) from the patients and redeploy post sanitization. Under the program, HUL has donated the OCs to Foundation who will have the title/ownership of the OCs and the logistics to be managed by Portea. To avail OCs under this Program, the representative of the Patient or beneficiary (“Beneficiary”) to do a missed call on the number 08068065385 (“Hope Program”).
• The HOPE program is effective since 10^th May 2021.

• Eligibility criteria to become beneficiary of HOPE Program: To avail OCs under HOPE program the following are the requirement:

a)  Medical

i)   RT PCR/CT Scan Doctor's Prescription

ii)  Doctor Prescription

iii)  SPO2 level: Range 88-94

iv)  LPM Prescribed: < 5 LPM

b)  KYC

i)   Identity Proof (ID) Proof

ii)  Address Proof

iii) BPL Card (for no security deposit)

• HOPE program has been extended in select cities across India and is extended to BPL beneficiaries on ‘first  come first serve’ basis depending upon the availability, fulfilling all other eligibility criteria in clause 2. However, the same if required can be extended to Non-BPL beneficiaries after fulfilling all other eligibility criteria as per 2 above except the BPL card and after providing a refundable Security Deposit of Rs.10,000/-. • In case, you do not opt for online transfer, then provide a Cheque in the name of beneficiary or in the name of the person making the Security Deposit payment.. However, in no situation, the receipt of Security Deposit will be permitted in cash. The Security Deposit shall be refunded after satisfactory return of OCs within 7 business days subject to deductions for any damages to the OCs.
• The Beneficiary shall keep and maintain the OCs in good and substantial repair, condition and appearance in order to keep it in as good an operating condition as it was on the commencement date of the Contract (fair wear and tear only accepted). Further, it shall be ensured that no unauthorised transfers or diversions of the Equipment occurs.

• This is a charitable program and the object of the HOPE program is to serve as many patients as possible. The beneficiary of HOPE Program shall return the OCs at the end of 15 days or before in case the beneficiary does not require the OC as per medical advice.
• OCs shall be used under the medical supervision of the beneficiary’s treating doctor. OCs shall be used as per the medical prescription provided by the beneficiary’s treating doctor.(The beneficiary of HOPE Program shall return the OCs at the end of 15 days or before in case the beneficiary does not require the OC as per medical advice) 

• While it is the endeavour of Portea to provide OCs to eligible patients, it is understood by the beneficiary that Portea may not be in a position to fulfil all requests that they receives due to non-availability of OCs. In case of any OC related support required by the beneficiary, the beneficiary is requested to contact on the number provided in 1 above and Portea shall endeavour to call back

However, it is understood by the beneficiary that there could be a delay in getting back by Portea due to call overload.

• OCs are electronic, electro-mechanical devices and must be operated as per manufacturer’s manual or as explained and demonstrated by Portea technician. Portea explicitly makes it clear that the OCs can fail to function due to improper usage by not following proper instructions, power fluctuation / failure, failure of component etc and the same is understood by beneficiary. Portea will not be liable for any damages or consequential damages caused by failure of OC to function at beneficiary’s place, which are beyond the control of Portea.

• Beneficiary undertakes to ensure that OC will be always in his possession and to maintain it in good form and will not be used for any illegal purposes.

• The HOPE program is operated by Portea in collaboration with HUL and the KVN Foundation and thus, reserves the right to change/modify, cancel or terminate at its own discretion without any notice to that effect. Also, they shall also not be responsible for any loss or damage if they have to discontinue or cancel the HOPE Program in compliance with any statutory legislation/guidance/instruction or for any other unavoidable reason beyond their control.

• HUL shall not have any liability of any kind, whatsoever, towards the end user or the patient or the beneficiary since HUL has no privity of contract with them and the same shall be dealt by the Foundation or Portea. In no event HUL shall be liable for losses or any incidental or consequential damages arising out of or in connection with the Program.
• By accepting the OCs under the HOPE program, the beneficiary has and is deemed to have accepted these terms and conditions
• All disputes are subject to Bangalore jurisdiction
